Acceptance

By using this website, sending us an email, calling us, or texting our business line, you agree to these terms. If you do not agree, do not use the site or the SMS program.

These terms cover the website and our SMS communications. They are NOT the engagement agreement for advisory work. Advisory work is governed by a separately-signed Master Services Agreement and Statement of Work.

About Durango Advisors

Durango Advisors, LLC is a Colorado limited liability company providing professional advisory services. The Managing Member is Brian Thornton. This website is informational. Submitting an inquiry, exchanging messages, or holding a discovery call does not create an advisory, fiduciary, or attorney-client relationship between you and Durango Advisors. A formal advisory relationship begins only when both parties sign an engagement letter or Statement of Work.

SMS / Text messaging program

Durango Advisors runs a small-business SMS program through Twilio for the practical purpose of coordinating with prospects and clients. It is not a marketing list, and we do not send bulk promotional messages.

SMS Program Terms

Program name: Durango Advisors business SMS.
Operator: Durango Advisors, LLC, using Twilio as the messaging carrier.
Consent: by giving us your phone number through the contact form, by email, by voice, or by initiating an SMS to our business line, you consent to receive SMS from Durango Advisors related to your inquiry or active engagement.
Program content: scheduling, appointment confirmations, short operational notes about a current or prospective engagement. We do not send promotional or marketing SMS.
Frequency: message frequency varies. Typically a small number of messages per month, sent only as the conversation requires.
Cost: message and data rates may apply per your mobile carrier.
HELP: text HELP at any time to receive a reply with contact information.
STOP: text STOP at any time to opt out. You will receive one confirmation reply, after which Durango Advisors will not send further SMS messages to that number unless you opt back in.
Re-opt-in: after a STOP, you can opt back in by sending us a new message asking to resume, or by replying START.
Supported carriers: the program operates over major US wireless carriers including AT&T, Verizon, T-Mobile, and their subsidiaries and resellers.
Carrier liability: mobile carriers are not liable for delayed or undelivered messages.
Privacy: we do not sell, rent, or transfer your phone number or message content to any third party for their own marketing. See the Privacy Policy.

Website use

You may view, read, and link to durangoadvisors.com. You may not scrape it for commercial datasets, republish it in whole or significant part, or use its content to train AI systems without prior written permission. AI crawlers are disallowed via Cloudflare's managed robots.txt at the platform level.

Intellectual property

All site content, including text, photography, the visual system, and the "Durango Advisors" name and word mark, is owned by Durango Advisors, LLC or licensed to us. You receive no rights in any of it by using the site.

Confidentiality of inquiries

Information you send us through the contact form, by email, or by SMS is handled with professional discretion. Submission alone does not establish a contractual confidentiality obligation; a mutual non-disclosure agreement or executed engagement letter does. For a confidential exploratory conversation, ask for an NDA before sending substantive detail.

No warranties

The site and the SMS program are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not guarantee that any specific message will be delivered or received.

Limitation of liability

To the maximum extent permitted by law, Durango Advisors will not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the site or the SMS program, even if we have been advised of the possibility of such damages. Our maximum aggregate liability for any claim related to the site or the SMS program is limited to one hundred US dollars (USD 100). Nothing in these terms limits liability that cannot be limited under applicable law.

Indemnification

You agree to indemnify and hold Durango Advisors harmless from any claim arising out of your misuse of the site or the SMS program, including unauthorized scraping, abuse of the contact form, or sending SMS content that violates law or carrier rules.

Governing law

These terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles. Any dispute arising from these terms or your use of the site or SMS program will be resolved in the state and federal courts located in Colorado, and you consent to personal jurisdiction there.

Changes

We may update these terms. The effective date at the top of the page reflects the most recent update. Material changes will be highlighted on the page for a reasonable period. Your continued use of the site or the SMS program after a change constitutes acceptance of the updated terms.
